|
||||
|
||||
Настоящий документ «Лицензионное соглашение с конечным пользователем» представляет собой предложение физического лица (автор дериватива Melawy Linux (Melawy OS)) "Фадеева Валерия" (далее — «Правообладатель») заключить соглашение на изложенных ниже условиях.
|
||||
|
||||
1. Термины и определения EULA
|
||||
|
||||
1.1. Используемые в настоящем Лицензионном соглашении слова и выражения имеют следующие значения, если иное прямо не определено далее по тексту:
|
||||
|
||||
а) Лицензионное соглашение — текст настоящего документа со всеми приложениями, изменениями и дополнениями к нему, размещенный на / в дистрибутиве Продукта или на Сайте Правообладателя в сети Интернет по адресу: melawy.ru .
|
||||
|
||||
б) Пользователь — лицо, заключившее настоящее Лицензионное соглашение с Правообладателем в своем или чужом интересе в соответствии с требованиями действующего законодательства и настоящего Лицензионного соглашения.
|
||||
|
||||
в) Продукты — принадлежащие Правообладателю программы для ЭВМ и/или базы данных, экземпляр которых правомерно находится у конечного Пользователя.
|
||||
|
||||
г) Дистрибутив Linux — это скомпонованный в дистрибутивный пакет подобранный набор компонентов операционной системы Linux — ядро, библиотеки и утилиты проекта GNU, программа установки, другие утилиты и программы для Linux.
|
||||
|
||||
Как правило, дистрибутив Linux содержит базовые компоненты, в том числе загрузчик, ядро Linux, систему инициализации, программы-демоны, графический сервер и приложения.
|
||||
|
||||
Дистрибутивы Linux разработаны для удовлетворения различных потребностей пользователей, начиная от серверов и настольных компьютеров и заканчивая встроенными системами. Например, в серверные дистрибутивы включаются различное серверное программное обеспечение (веб-серверы, СУБД), в настольные — среды рабочего стола, офисные пакеты, проигрыватели мультимедиа.

||||
|
||||
д) Дериватив Linux — это операционная система, созданная путём модификации существующего дистрибутива Linux для удовлетворения конкретных целей или потребностей пользователя.
|
||||
|
||||
Разработчики дериватива часто изменяют пакеты программного обеспечения, конфигурации и поведение системы, чтобы создать адаптированные решения.
|
||||
|
||||
2. Лицензия на использование программного обеспечения
|
||||
|
||||
2.1. По настоящему Лицензионному соглашению Правообладатель предоставляет Пользователю право использования Продуктов на условиях простой (неисключительной) лицензии.
|
||||
|
||||
Правообладатель является разработчиком данного дериватива (приложила интеллектуальный труд к созданию, сбору, интеграции, адаптации программного обеспечения), а также части программ, входящих в его состав.
|
||||
В соответствии с данным Лицензионным соглашением Вы не приобретаете права собственности, авторские права на дериватив или программное обеспечение, входящее в его состав, а также размещенное в интернете, которое может быть запущено / исполнено при работе в данном деривативе Melawy Linux (Melawy OS).
|
||||
|
||||
2.2. Для заключения настоящего Лицензионного соглашения на изложенных в нем условиях достаточно совершения Пользователем любого из указанных ниже действий:
|
||||
|
||||
Поставить флажок в поле с текстом, явно означающим согласие.
|
||||
Нажать на кнопку и с текстом, явно означающим согласие.
|
||||
Вписать слова согласия в поле, явно предназначенным для этого.
|
||||
Нажать Продолжить или Далее, если предыдущих вариантов не предусмотрено в программе установки программного обеспечения.
|
||||
|
||||
Выполнение указанных выше действий подтверждает ознакомление и полное безоговорочное принятие Пользователем условий, изложенных в настоящем документе, и создает между Пользователем и Правообладателем договор на приведенных условиях в соответствии с положениями ст.437 и 438 Гражданского кодекса Российской Федерации.

2.3. Пользователь вправе использовать Продукты в соответствии с условиями настоящего Лицензионного соглашения следующими способами:
|
||||
|
||||
- применять / выполнять / запускать программу в любых целях,
|
||||
- дорабатывать программу под свои нужды,
|
||||
- обмениваться программой со своими друзьями и соседями и другими людьми,
|
||||
- обмениваться изменениями, которые вы внесли.
|
||||
|
||||
2.4. Лицензионное вознаграждение за использование программного обеспечения
|
||||
|
||||
Не применяется. Данный дериватив распространяется бесплатно, безвозмездно, то есть даром.
|
||||
|
||||
Поблагодарить автора дериватива Melawy Linux (Melawy OS) (поддержать, пожертвовать деньги) Вы можете любым способом, указанным по ссылке melawy.ru/donate или на сайте melawy.ru.
|
||||
|
||||
Вы можете нанять автора для решения вопросов или консультаций, которые возникают у Вас при использовании программ, входящих в состав дериватива Melawy Linux (Melawy OS) или не входящих в него.
|
||||
|
||||
3. Ограничения использования программного обеспечения
|
||||
|
||||
Вы не имеете права использовать данный Продукт в противоправных целых. В случае использования данного Продукта в противоправных целях права, полученные Вами при принятии данного Лицензионного соглашения отзываются / прекращаются.
|
||||
|
||||
Данное Лицензионное соглашение разрешает Вам устанавливать / использовать данное программное обеспечение на любом количестве устройств, с любым количеством пользователей, которые могут получить доступ к нему.
|
||||
|
||||
Данный дериватив Melawy Linux (Melawy OS) является модификацией дистрибутива Arch Linux.
|
||||
|
||||
Данный дериватив как и многие другие дистрибутивы и деривативы, не связанные с автором содержат в своём составе программное обеспечение как разработанное их авторами, так и сторонними разработчиками (авторами) иных программ.
|
||||
|
||||
Таким образом дериватив представляет собой готовый продукт, в котором собраны и интегрированы друг с другом различные программы от разных авторов.
|
||||
|
||||
У каждой программы имеется собственное лицензионное соглашение, которое Вы принимаете, начав использовать каждое конкретное программное обеспечение.
|
||||
|
||||
Данный дериватив распространяется КАК ЕСТЬ, БЕЗ каких-либо дополнительных ГАРАНТИЙ качества, пригодности, гарантий на то, что он (дериватив) или программы в его составе будут работать, приносить Вам удовольствие, прибыль или что-либо ещё.
|
||||
|
||||
Данный дериватив и программы в его составе не гарантируют сохранность Ваших данных и целостность Вашего аппаратного обеспечения (компьютера, телефона, устройства и тому подобное).
|
||||
|
||||
Программы написаны людьми, а люди, как и любые другие существа способны ошибаться, поэтому данный дериватив и программное обеспечение, входящее в его состав ОБЯЗАТЕЛЬНО СОДЕРЖАТ ОШИБКИ. Разработчики стремятся сократить количество ошибок в своём программном обеспечении, но не гарантируют их отсутствие.

||||
Начав использовать данный дериватив Вы полностью принимаете на себя все риски, ответственность, связанную с этим фактом. ИНАЧЕ Вы ОБЯЗАНЫ ПРЕКРАТИТЬ ИСПОЛЬЗОВАТЬ данный дериватив и / или программное обеспечение, входящее в его состав.

4. Политика конфиденциальности

Автор не собирает, не хранит, не обрабатывает и не пересылает Ваши персональные и биометрические данные.

||||
|
||||
5. Заключительные положения
|
||||
|
||||
Данное Лицензионное соглашение распространяет своё действие на данный вариант дериватива Melawy Linux (Melawy OS), приложенный к данному выпуску.
|
||||
|
||||
Территория действия Лицензионного соглашения - весь мир.
|
||||
|
||||
Срок действия Лицензионного соглашения - до момента публикации следующей версии лицензионного соглашения.
|
||||
|
||||
Условия Лицензионное соглашение могут быть изменены и отражены в следующем выпуске дериватива, путём размещения ISO-образа, в котором будет находиться данное Лицензионное соглашение, а также на сайте melawy.ru .
|
||||
|
||||
К автору не могут быть применены никакие требования, в том числе требование возмещения вреда (убытков) явного или косвенного, так как используя (в том числе выполняя / запуская данное программное обеспечение на устройстве) Вы берете на себя все риски, связанные с этим.
|
||||
|

||||
|
||||
This document "End User License Agreement" is an offer by an individual (the author of the Melawy Linux (Melawy OS) derivative) "Fadeeva Valeria" (hereinafter referred to as the "Copyright Holder") to enter into an agreement on the terms and conditions set forth below.

||||
1. EULA Terms and Definitions

||||

||||
1.1. The words and expressions used in this License Agreement have the following meanings, unless otherwise expressly defined below in the text:

||||
a) License Agreement — the text of this document with all appendices, amendments and additions to it, posted on / in the Product distribution or on the Copyright Holder's Website on the Internet at: melawy.ru .

||||
|
||||
b) User — a person who has entered into this License Agreement with the Copyright Holder in his or her own or someone else's interests in accordance with the requirements of the current legislation and this License Agreement.

||||
|
||||
c) Products — computer programs and/or databases owned by the Copyright Holder, a copy of which is lawfully in the possession of the end User.
|
||||
|
||||
d) Linux distribution — a selected set of Linux operating system components compiled into a distribution package — the kernel, libraries and utilities of the GNU project, the installation program, other utilities and programs for Linux.
|
||||
|
||||
As a rule, a Linux distribution contains basic components, including a boot loader, Linux kernel, initialization system, daemon programs, a graphical server and applications.
|
||||
|
||||
Linux distributions are designed to meet various user needs, from servers and desktop computers to embedded systems. For example, server distributions include various server software (web servers, DBMS), while desktop distributions include desktop environments, office suites, and multimedia players.
|
||||
|
||||
e) Linux derivative — an operating system created by modifying an existing Linux distribution to meet specific user goals or needs.
|
||||
|
||||
Derivative developers often modify software packages, configurations and system behavior to create customized solutions.
|
||||
|
||||
2. Software License
|
||||
|
||||
2.1. Under this License Agreement, the Copyright Holder grants the User the right to use the Products under a simple (non-exclusive) license.
|
||||
|
||||
The Copyright Holder is the developer of this derivative (applied intellectual labor to the creation, collection, integration, adaptation of the software), as well as part of the programs included in it.
|
||||
In accordance with this License Agreement, you do not acquire ownership rights, copyrights to the derivative or software included in it, as well as posted on the Internet, which can be launched / executed when working in this Melawy Linux (Melawy OS) derivative.
|
||||
|
||||
2.2. To conclude this License Agreement on the terms and conditions set forth herein, it is sufficient for the User to perform any of the following actions:
|
||||
|
||||

Click the button and with the text that clearly indicates consent.
|
||||
Enter the words of consent in the field clearly intended for this.
|
||||
Click Continue or Next if the previous options are not provided in the software installation program.

Following the above actions confirms that the User has read and fully and unconditionally accepted the terms and conditions set forth in this document, and creates an agreement between the User and the Copyright Holder on the stated terms in accordance with the provisions of Articles 437 and 438 of the Civil Code of the Russian Federation.

||||
2.3. The User has the right to use the Products in accordance with the terms of this License Agreement in the following ways:
|
||||
|
||||
- apply / execute / run the program for any purpose,
|
||||
- modify the program to suit your needs,
|
||||
- share the program with your friends and neighbors and other people,
|
||||
- share the changes you have made.
|
||||
|
||||
2.4. License fee for using the software
|
||||
|
||||
Not applicable. This derivative is distributed free of charge, gratuitously, that is, for nothing.
|
||||
|
||||
You can thank the author of the Melawy Linux (Melawy OS) derivative (support, donate money) in any way indicated at the link melawy.ru/donate or on the website melawy.ru.
|
||||
|
||||
You can hire the author to resolve questions or consult you may have when using programs included in the Melawy Linux (Melawy OS) derivative or not included in it.
|
||||
|
||||
3. Software Usage Restrictions
|
||||
|
||||
You have no right to use this Product for illegal purposes. In case of detection of illegal nature of use of this Product, the rights received by you upon acceptance of this License Agreement are revoked / terminated.
|
||||
|
||||
This License Agreement allows you to install / use this software on any number of devices, with any number of users who can access it.
|
||||
|
||||
This Melawy Linux (Melawy OS) derivative is a modification of the Arch Linux distribution.
|
||||
|
||||
This derivative, like many other distributions and derivatives not associated with the author, contains software developed by their authors, as well as third-party developers (authors) of other programs.
|
||||
|
||||
Thus, the derivative is a finished product that collects and integrates various programs from different authors.
|
||||
|
||||
Each program has its own license agreement, which you accept by starting to use each specific software.
|
||||
|
||||
This derivative is distributed AS IS, WITHOUT any additional WARRANTIES of quality, suitability, guarantees that it (the derivative) or the programs in it will work, bring you pleasure, profit or anything else.

||||
|
||||
This derivative and the programs in it do not guarantee the safety of your data and the integrity of your hardware (computer, phone, device, etc.).

||||

||||
Programs are written by people, and people, like any other creatures, are capable of making mistakes, therefore this derivative and the software included in it NECESSARILY CONTAIN ERRORS. The developers strive to reduce the number of errors in their software, but do not guarantee their absence.

By starting to use this derivative, you fully assume all risks and liability associated with this fact. OTHERWISE, you MUST STOP USING this derivative and / or the software included in it.

||||

The License Agreement is valid until the next version of the License Agreement is published.

||||
|
||||
The terms of the License Agreement may be changed and reflected in the next release of the derivative by posting an ISO image containing this License Agreement, as well as on the melawy.ru website.

||||
|
||||
No claims may be made against the author, including claims for compensation for damages (losses), explicit or implicit, since by using (including executing / running this software on the device) you assume all risks associated with this.
